THE CANADIAN BRAIN TISSUE BANK As advances continue to be made in research laboratories throughout the world, more and more people are beginning to appreciate the enormous potential of post-mortem human brain tissue research. What the public does not seem to realize, however, is that although promising results are being reported and our understanding of severe neurologic and psychiatric disorders is improving, more significant progress is actually being delayed because of a scarcity of brain tissue donations. The Canadian Brain Tissue Bank was established in 1981 in order to support medical research through the collection, storage, and distribution of brain tissue to interested scientific investigators. Such research is concerned with the causes, treatments and eventual cures for the many psychiatric and neurological disorders affecting so many people today. These include schizophrenia, Alzheimer's disease, dystonia, epilepsy, among many others. Research over the past decade has shown that the study of human brain tissue is essential to increasing our understanding of how the nervous system functions, and consequently in preventing and alleviating these illnesses. Most recently, post-mortem human brain research played a significant role in the development of a genetic test for Huntington's disease and a treatment for Parkinson's disease. Additionally, human brain tissue is necessary because several serious neurologic and psychiatric conditions affect only humans and therefore, animal models are not relevant. For comparative purposes, brain tissue is needed from healthy individuals, as well as from those who died with a neurologic or psychiatric illness. There is also a critical need for relatives of people with genetically inherited disorders to donate their brains after death. Samples of DNA are kept from all tissue to help in future genetic testing.

In a period of four years no other publications appeared using cationic CDs in CE separations, then Fanali and co-workers [50] mentioned the use of 6A-methylamino--CD 6A-MA--CD ; and 6A, 6Ddimethylamino--CD 6A, ; for the enantiomeric resolution of some 2-hydroxy acids. Since then only a few other cationic derivatives have been mentioned in the literature. 6-Methylamino--CD MA--CD ; , with several degrees of substitution at the 6-position, was used in the chiral separation of several acidic and basic compounds [112] as listed in Table 7.2. In the latter paper, it was shown that the degree of substitution at the 6position affected the chiral resolution of fenoprofen: It was not baseline separated using mono-MA--CD, but was baseline separated when using hepta- MA--CD. And, as discussed below, the FCA is not the only federal statute establishing liability for fraud against Medicare and Medicaid. But the FCA is unique in rewarding private citizens for bringing fraud to the attention of federal authorities. These qui tam provisions of the FCA, combined with its treble damages provisions, have made it the most powerful tool available to the federal government for identifying and deterring complex, large-scale corporate fraud against federal health care programs. In the view of the Department of Justice, the FCA is "the United States' primary tool against fraud upon the government."52 Under the FCA, a private party acting on the government's behalf may sue any government contractor that has knowingly submitted false or fraudulent claims for federal funds. While the case is under seal, the DOJ investigates the case often with the assistance of the FBI or OIG ; to decide whether to intervene. If DOJ decides to intervene, it typically attempts to negotiate a settlement with the defendant while the matter is still under seal. If DOJ decides not to intervene, the court will lift the seal and the relator may proceed on his own.54 A defendant found liable under the FCA faces treble damages plus penalties ranging from $5, 500 to $11, 000 for each false claim.55 The qui tam plaintiff is entitled to share in favorable settlements or judgments depending upon his or her level of contribution to the case. If the government decides to intervene in the case, the relator may receive between 15% and 25% of the recovery; if the government elects not to intervene, the relator receives between 25% and 30% of the recovery.56 On average in FCA health care cases in which the government intervenes, whistleblowers receive about 16 per, for example, atenolol.
